1. PURPOSE AND DEFINITIONS

1.1 Service Purpose: TokenComic is a community digital platform that allows content creators (writers, illustrators, artists) to publish works and monetize them through a utility-token system (TINKR). Reader users can acquire TINKR to access collectibles and exclusive content within published works.

TokenComic is NOT an investment platform, a cryptocurrency exchange, a securities fund or financial instrument, or a regulated money exchange.

TokenComic IS a Web3 digital content marketplace, a monetization platform for creators, and a utility system based on blockchain.

1.2 Key Definitions: User, Creator, Reader, TINKR (ERC-20 on Arbitrum One), Collectibles and Platform Fee (currently 25%).

2. ELIGIBILITY AND REGISTRATION

2.2 Age and Responsibility Declaration: by clicking Create Account, you declare you are of legal age according to your country or jurisdiction.

NOTICE: if you are underage, you must NOT register without parental consent. Parents or guardians are responsible for monitoring activity and assuming all purchase responsibility.

2.3 Account Responsibility: you are fully responsible for keeping your password confidential. TokenComic is not responsible for unauthorized access and you must immediately report any unauthorized access.

• Provide a valid and verified email
• Fully accept these Terms and Conditions
• Comply with all applicable laws

3. TINKR NATURE - NOT AN INVESTMENT

3.3 No Value Guarantee: TokenComic does NOT guarantee minimum value, liquidity, secondary markets, or conversion to fiat at any time.

• TINKR is a pure utility token for access to services within TokenComic
• It is NOT an investment, tradable security, financial instrument, return promise, or bank deposit
• It exists to buy collectibles, access exclusive content and reward creators
• Future trading on public markets may exist only if users choose to do so

4. PURCHASE AND USE OF TINKR

4.2 Pricing and Transactions: prices may change without prior notice. All transactions are final and irrevocable. No refunds, reversals, or chargebacks.

4.3 Transaction Responsibility: users are responsible for verifying addresses and amounts. TokenComic is not liable for transfer errors, wrong addresses, loss of wallet access, or user-device security breaches.

• Direct payment to TokenComic (enabled platform methods)
• Cryptocurrency transfer (USDC, USDT on Arbitrum)
• Other methods authorized by TokenComic

5. CREATOR OBLIGATIONS AND RIGHTS

5.2 Earnings and Platform Fee: when a reader buys, 100% of TINKR is credited in operation; TokenComic retains 25% and the creator receives 75%.

Example: 100 TINKR -> TokenComic 25 TINKR -> Creator 75 TINKR.

5.3 Earnings Withdrawal: creators may request withdrawal and conversion to Stablecoins (USDC/USDT), COP via Bold or another authorized provider, or any method authorized by TokenComic.

5.4 Withdrawal Times: withdrawals are processed in 5-10 business days. TokenComic may reject withdrawals due to insufficient funds, T&C breach, suspected fraud, or maintenance.

• Do not infringe copyright, trademarks, or privacy rights
• Do not publish obscene, violent, discriminatory, or illegal content
• Comply with local laws in each jurisdiction

6. LIMITATION OF LIABILITY

6.1 AS-IS: TokenComic is provided without implied warranties of continuous availability, absolute security, minimum performance, or fitness for a specific purpose.

6.2 Maximum Liability Limit: TokenComic shall not be liable for indirect, incidental, special, or punitive damages; or for loss of profits, business opportunities, or reputation.

MAXIMUM LIABILITY: the total amount of TINKR in your account.

7. PROHIBITIONS AND VIOLATIONS

7.2 Sanctions: TokenComic may permanently suspend accounts, confiscate non-withdrawn TINKR, report to authorities, or seek legal damages.

• Money laundering or unlawful activities
• Multiple accounts to bypass limits
• Platform attacks or hacking
• Malware or malicious code publication
• Harassment, spam, or impersonation
• Copyright infringement

8. LEGAL COMPLIANCE

8.1 TokenComic follows guidance from the Colombian Financial Superintendence and treats TINKR as a utility token, not a regulated security.

8.2 Taxes: users are responsible for reporting TINKR income before DIAN. TokenComic may provide transaction reports.

8.3 AML/CTF: FATF-aligned compliance; transactions from sanctioned jurisdictions may be rejected and suspicious activity may be reported.

9. DATA PROTECTION AND PRIVACY

TokenComic does NOT sell your personal information to third parties.

• Usage data (analytics)

10. DISPUTE RESOLUTION

These Terms are governed by Colombian law.

Any legal action shall take place in courts of Bogota, Colombia.

By using the platform, you agree to Colombian jurisdiction.

11. PROHIBITION OF INAPPROPRIATE CONTENT AND ILLEGAL CONDUCT

TokenComic maintains a zero-tolerance policy regarding content that violates human integrity. By using our platform, you commit to not publishing, sharing, or promoting material that includes:

• Sexual Content and Exploitation: The publication of explicit sexual content, pornography, or any form of sexual exploitation is strictly prohibited, with special emphasis on the protection of women. The focus of works should never center on sexualized scenes that degrade human dignity.
• Child Protection: No content involving exploitation, sexualization, or abuse of minors is permitted. Any indication of such practice will result in the immediate expulsion of the user.
• Violence and Degradation: All content that evokes, promotes, or displays practices of injury, mutilation, torture, or any form of physical or psychological degradation of people is prohibited.
• Illegal Activities: Content that incites illegal practices under current regulations will not be tolerated.

12. CONSEQUENCES AND REPORTING

Any content that violates these rules will be removed without prior notice. Furthermore, TokenComic reserves the right to permanently suspend the offender's account, and in cases of severity or illegality, the information will be reported to the competent authorities.
